GENERAL TERMS OF USE FOR THE WEBSITE

Effective as of 01 March 2022

The purpose of the present general terms of use (known as "GTU") is to provide a legal framework for the terms and conditions for the provision of the site and services by CERTIFICATEUR DE CARTES DE COLLECTION "The Company" or "The Publisher" and to define the conditions of access to and use of the services by "the User".
The present GTC are accessible on the site under the heading "Terms of website use".

Any registration or use of the site implies acceptance without reservation or restriction of these TOS by the user. When registering on the site via the Registration Form, each user expressly accepts the present GTU by checking the box preceding the following text: "I have read and accept the GTU of the site and the Privacy Policy".
In case of non-acceptance of the GTU stipulated in this contract, the User must renounce the visit and access to the services offered by the site.
The Company reserves the right to unilaterally modify the content of these GTUs at any time.

NON-MEMBERSHIP / NON-AFFILIATION

CCC Grading has a logo containing three stripes: one blue, one white and one red for purely aesthetic purposes to break the uniformity of the single-color logo, while representing our location and the origin of our products.
In no case CCC Grading claims a state or government affiliation. CCC Grading is not a company that has been approved by any French government department.
The colors are different from those of the French flag: a blue tending towards cyan and a burgundy red.
The customer understands that this practice is not intended to be misleading and renounces to claim that he would have been deceived by the use of these three colors.

Moreover, CCC Grading is an independent provider and does not claim any affiliation with the following entities:

ACCESS TO THE SITE

The Site is accessible everywhere, 7 days a week, 24 hours a day, except in cases of force majeure, scheduled or unscheduled interruption and which may result from a need for maintenance.

In case of modification, interruption or suspension of the Site, the Editor cannot be held responsible.

The Services are only accessible through the Website and the User shall consequently make sure to have an Internet connection ensuring an optimal access. The Company shall not be liable for any difficulty in accessing the Services or the Web Site, or for any bug or error that may occur during the placing of an Order as a result of a failure in the User's Internet connection.

The Company may modify the functionalities or any other content of the Website at its own discretion without this constituting a compensable prejudice for Visitors or Users.

Proposed services and obligations of the User

The cccgrading.com site allows the User a free access to certain services. Within the framework of the use of these services, the User has the obligation to read and to respect the General Terms and Conditions of Sale (GTC) which frame these last ones.

The services offered are :

• Establishment of an order for the card certification service from a form with entries chosen by the User.
  
  

This service requires the User to read all the instructions for filling in the order form, including the specific instructions next to each field.
The User is also obliged to fill in the fields truthfully and accurately when entering the details of the cards he/she wishes to send. The User undertakes to research the information to be filled in to ensure that it is as accurate as possible, particularly with regard to arbitrary fields such as the "Declared Value" of each of the cards in accordance with the "Declared Value" article described in the General Terms of Sale.
The sanctions applicable in the event of non-compliance with this obligation are described in the GTC.

• Viewing the details of certified cards
• View the population report of the cards certified by CCC Grading.
  
  

The non-member User does not have access to certain reserved services. For this, he must register by filling out the form. By agreeing to register for the reserved services, the member User agrees to provide truthful and accurate information regarding his or her marital status and contact information, including email address.

To access the services, the User must then identify himself using his login and password which will be communicated to him after his registration.

Any User who is a regularly registered member may also request to unsubscribe by going to the dedicated page on his personal space. This will be effective within a reasonable time.
Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in case of maintenance, does not engage the responsibility of cccgrading.com. In these cases, the User agrees not to hold the editor responsible for any interruption or suspension of service, even without notice.
The User has the possibility of contacting the site by electronic messaging to the email address of the editor communicated in the Legal Notice above.

The company may suspend the processing of an Order or cancel an Order due to a proven violation of the GCU, without any right to compensation for the User.

Intellectual property

The brands, logos, signs and all content of the site (text, images, sound ...) are protected by the Code of Intellectual Property and more particularly by copyright.

The CCC GRADING brand is a registered trademark. Any representation and / or reproduction and / or partial or total exploitation of this mark, of any kind whatsoever, is totally prohibited.

The User must request prior authorization from the site for any reproduction, publication, copy of the various contents. The User undertakes to use the contents of the site in a strictly private context, any use for commercial and advertising purposes is strictly prohibited.
Any total or partial representation of this site by any process whatsoever, without the express permission of the operator of the website would constitute an infringement punishable by Article L 335-2 and following of the Code of Intellectual Property.
It is recalled in accordance with Article L122-5 of the Code of Intellectual Property that the User who reproduces, copies or publishes the protected content must cite the author and its source.

Responsibility

The Company shall not be liable for the prejudicial consequences of any loss of data or programs due to a technical failure, the host, or a computer virus. It shall not be liable for any misappropriation of the User's data by a third party and by any means whatsoever during the transmission of such data on the Website.

The User and the Visitor must use or visit the Website and the Services in accordance with the present terms and conditions and in accordance with their destination and purpose; as such, any use of the Website under conditions or for purposes that are contrary to public order or illicit or in contradiction with any rights of third parties is prohibited.

Cookies

The User is informed that during his visits on the site, a cookie can be automatically installed on his browser. Cookies are small files temporarily stored on the hard disk of the User's computer by your browser and which are necessary for the use of the cccgrading.com website.

Cookies do not contain personal information and cannot be used to identify anyone. Some cookies expire at the end of the User's visit, others remain. The information contained in the cookies is used to improve cccgrading.com, our understanding and analysis of the users visiting us.

Applicable law and jurisdiction

French law applies to this contract.
